TERMS OF SERVICE

Effective Date: August 1, 2026

These Terms of Service ("Terms") govern your use of Soul TCG, including soultcg.com, all pages, features, products, services, accounts, purchases, promotions, events and other services made available by Soul TCG (collectively, the "Services").

By accessing, browsing, creating an account, placing an order, purchasing a product, participating in an event or otherwise using the Services, you agree to these Terms, our Return & Refund Policy, Privacy Policy, Shipping Policy, and any product-, promotion-, event- or platform-specific terms incorporated into them.

If you do not agree to these Terms, you must not use the Services.

1. Who We Are

Soul TCG ("Soul TCG", "we", "us", "our") operates a collectible trading-card and hobby retail business in Canada, including online sales, local sales, collectibles, trading cards, sealed products, singles, graded cards, accessories, fan art, merchandise, events, livestream sales and related services.

Our website is hosted on Shopify Inc., which provides the e-commerce platform used to offer our Services.

Where a transaction is completed through a third-party platform such as Whatnot, the applicable third-party platform terms also apply.

2. Eligibility

You represent that you are legally capable of entering into a binding agreement under the laws applicable to you.

If you are under the applicable age of majority, you may use the Services only with the involvement and permission of a parent or legal guardian where required by law.

You may not use the Services for any unlawful, fraudulent or unauthorized purpose.

3. Acceptance of Orders

Placing an order is an offer to purchase the selected merchandise. An order confirmation means that we have received your order; it does not necessarily mean that Soul TCG has accepted the order.

Soul TCG accepts an order when we ship it, make it available for pickup, or otherwise expressly confirm acceptance.

Until acceptance, Soul TCG reserves the right, at our sole discretion and to the extent permitted by law, to refuse, limit, modify or cancel an order for any legitimate reason, including:

• Inventory or availability issues
• Pricing or listing errors
• Failed payment
• Failed purchaser, payment or address verification
• Suspected fraud
• Suspected stolen payment credentials
• Suspected resale or commercial purchasing
• Purchase-limit violations
• Multiple-account activity
• Abuse of discounts, promotions or giveaways
• Incorrect or incomplete information
• Shipping restrictions
• Breach of these Terms
• Technical or system errors
• Other circumstances that make fulfillment unreasonable or impossible

Where we cancel an order before shipment, we will generally refund the affected amount to the original payment method.

An order cancellation does not constitute an admission of liability by Soul TCG.

This order-acceptance structure reflects the stronger protections used by the retailers reviewed, particularly Hobbiesville's distinction between order receipt and acceptance and its express right to cancel for verification, pricing, fraud and resale concerns.

4. Purchaser Verification

Soul TCG may place an order on hold while verifying the purchaser, payment method, billing information, shipping address or other transaction details.

We may request additional information or identification where reasonably necessary.

If verification cannot be completed to our reasonable satisfaction, Soul TCG may cancel the order and refund the affected amount.

We are not required to disclose internal fraud-prevention methods, screening criteria or security rules.

5. Accounts

Where accounts are offered, you are responsible for maintaining accurate information and protecting your login credentials.

You are responsible for activity conducted through your account.

You may not:

• Share an account for the purpose of circumventing restrictions
• Create multiple accounts to avoid quantity limits
• Use another person's payment information without authorization
• Provide false account information
• Transfer an account without our permission

Soul TCG may suspend, restrict or terminate an account where we reasonably believe it is being used for fraud, abuse, policy circumvention, resale activity or other prohibited conduct.

6. Order Limits & Resale

Soul TCG may impose quantity limits on any product, promotion, release, preorder, event or customer.

Limits may apply per:

• Person
• Household
• Customer account
• Payment method
• Credit card
• Billing address
• Shipping address
• Pickup location
• IP address
• Device
• Or other reasonably associated purchasing information

Where reasonably necessary, multiple orders may be treated as one order for purposes of enforcing an order limit.

Soul TCG may reduce or cancel orders that we reasonably believe:

• Exceed published limits;
• Circumvent a limit;
• Are placed through multiple accounts;
• Are intended primarily for unauthorized resale;
• Are intended to exploit limited inventory; or
• Otherwise undermine a fair distribution of limited products.

Where an order is reduced or cancelled before fulfillment, the affected amount will generally be refunded.

These protections are consistent with the order-limit and anti-resale provisions used by Hobbiesville, Magikart and Danireon.

7. Pricing, Currency & Taxes

Unless otherwise stated, prices are displayed in Canadian dollars (CAD).

Applicable taxes and shipping charges are calculated at checkout.

Prices may change without notice before an order is accepted.

Once an order has been accepted, the charged price will generally be the price shown at the time of purchase, subject to applicable pre-order, tariff, tax, supplier or legal requirements.

Soul TCG is not responsible for foreign-exchange differences, currency-conversion charges or fees imposed by banks, credit-card companies or payment providers.

8. Pricing, Listing & Technical Errors

Despite our efforts to maintain accurate listings, the website may occasionally contain typographical, inventory, pricing, promotional, product-description, shipping or technical errors.

Soul TCG reserves the right to correct errors, update information and cancel affected orders.

Where a product is listed at an obviously incorrect price or under materially incorrect terms because of a technical, typographical, inventory, supplier or system error, Soul TCG may cancel the affected order even after an order confirmation has been issued, to the extent permitted by law.

Any amount paid for a cancelled item will be refunded.

This incorporates the broad error-correction protection present in both Magikart and Danireon's terms while strengthening it with Hobbiesville's order-acceptance framework.

9. Promotions, Discounts & Coupons

Promotions, discounts, coupon codes, giveaways and special offers may be subject to additional terms.

Unless expressly stated otherwise:

• Promotions cannot be combined;
• Discounts cannot be applied retroactively;
• A discount cannot be added after checkout;
• Promotions have no cash value;
• Promotional benefits cannot be transferred;
• Soul TCG may impose quantity or eligibility restrictions; and
• Promotional abuse may result in order cancellation and account restriction.

Products purchased with a promotional offer may be subject to additional return or final-sale restrictions stated in the applicable promotion or Return & Refund Policy.

10. Payment

You must provide accurate and complete billing and payment information.

You represent that you are authorized to use the payment method submitted.

By placing an order, you authorize Soul TCG and its payment processors to charge the applicable amount.

Orders may be charged at the time the order is placed, including pre-orders where supported by the applicable payment method.

Soul TCG may refuse or cancel transactions where payment authorization fails or where fraud or unauthorized activity is reasonably suspected.

11. Chargebacks & Payment Disputes

If you have a problem with an order, you agree to contact Soul TCG and provide us a reasonable opportunity to investigate and resolve the issue before initiating a chargeback or payment dispute, except where applicable law or the applicable payment network gives you a right to proceed otherwise.

A knowingly false, fraudulent or misleading payment dispute may constitute a breach of these Terms.

Where a dispute is initiated, Soul TCG may provide the relevant payment processor, card issuer, marketplace or financial institution with applicable evidence, including:

• Order records
• Order confirmations
• Communications
• Product information
• Photographs
• Fulfillment records
• Tracking information
• Delivery records
• Pickup records
• Terms applicable to the transaction
• Livestream or event records where applicable

Soul TCG may restrict or decline future orders associated with fraudulent payment activity to the extent permitted by law.

Hobbiesville expressly treats certain improper chargebacks as a breach and states that it may provide the transaction record and applicable terms to the payment provider.

12. Trading Card Products

Trading card and collectible products are highly condition-sensitive and may involve randomized contents, fluctuating market values and manufacturer-controlled quality.

All trading card purchases are subject to the Soul TCG Return & Refund Policy.

Unless expressly stated otherwise, TCG products are final sale, subject only to legitimate product defects, material damage, fulfillment errors or other rights that cannot legally be excluded.

This includes sealed TCG products, booster packs, boxes, ETBs, tins, bundles, collections, singles, graded cards, mystery products, repacks, randomized products and similar products.

A change in market value, buyer's remorse, dissatisfaction with a pull or change in collecting preferences does not create a refund right.

13. Sealed Product & Manufacturer Defects

Sealed products may contain minor manufacturer or transportation-related cosmetic imperfections, including dents, scuffs, tears, shrink-wrap imperfections or other minor exterior packaging issues.

Minor cosmetic damage that does not materially affect the product is not necessarily grounds for refund, exchange or store credit.

Where a manufacturer defect exists inside a newly opened sealed product, Soul TCG may direct the customer to the applicable manufacturer or publisher replacement program, where one exists.

Examples may include:

• Missing cards
• Printing defects
• Misprints
• Missing game components
• Factory defects

Soul TCG may assist with identifying the appropriate manufacturer process but does not guarantee that a manufacturer will approve a replacement.

Hobbiesville follows a similar manufacturer-first approach for damaged, misprinted or missing cards/components.

14. Singles & Graded Cards

Trading card singles and graded cards are final sale except where required by applicable law or where Soul TCG has made a material fulfillment or listing error.

Market fluctuations do not constitute grounds for refund.

This includes increases or decreases in:

• Market price
• Collector demand
• Grading values
• Population reports
• Comparable sales
• Buylist values
• Resale value

Condition descriptions are based on Soul TCG's assessment and do not guarantee the opinion of any third-party grader or marketplace.

15. Mystery Products, Repacks & Randomized Products

Mystery products, repacks, randomized products and custom randomized bundles are final sale.

Opening such a product constitutes acceptance of the randomized contents.

A customer is not entitled to a refund because they:

• Did not receive a desired card;
• Did not receive a chase;
• Received a lower-valued card;
• Dislike the contents;
• Believe the purchase was poor value; or
• Changed their mind.

Where the advertised contents were not supplied or another legitimate fulfillment problem occurred, Soul TCG may review the transaction.

16. Pre-Orders

Pre-orders are reservations for products expected to be available at a future date.

A pre-order does not guarantee that the manufacturer or distributor will supply Soul TCG with the exact quantity originally anticipated.

Release dates, allocations, product specifications and availability may change.

Soul TCG may adjust, reduce or cancel a pre-order where manufacturer, distributor, allocation, supply, pricing, tariff, regulatory or other circumstances make fulfillment unavailable or unreasonable.

If Soul TCG cannot fulfill a pre-order, the affected amount paid will generally be refunded.

Additional product-specific pre-order terms may apply and form part of the transaction.

17. Shipping & Handling

Orders may require a handling period before shipment.

Delivery estimates are estimates only and are not guarantees.

Delays can occur due to:

• Carrier delays
• Weather
• Customs
• Holidays
• Labour disruptions
• High-volume periods
• Address issues
• Supply interruptions
• Manufacturer or distributor delays
• Other circumstances outside our reasonable control

Soul TCG may use Canada Post, UPS, FedEx or another carrier at our discretion or as selected at checkout.

We reserve the right to change shipping methods where reasonably necessary.

18. Shipping Address

You are responsible for providing an accurate and complete shipping address.

Changes to shipping addresses may not be possible after fulfillment has begun.

Once a package has been delivered by the carrier to the shipping address provided at checkout, the shipment may be considered delivered.

Customers are responsible for monitoring tracking information and taking reasonable steps to receive delivered packages.

19. Forwarding Services

If you use a package-forwarding, reshipping or intermediary delivery service, you assume responsibility once the package is delivered to the address provided to Soul TCG, except where applicable law provides otherwise.

If you provide a forwarding address, claims relating to what happens after delivery to that address should generally be made with the forwarding service.

This protection is specifically used by Danireon.

20. Lost, Stolen or Damaged Shipments

Customers are responsible for reviewing the shipping options and any package-protection option offered at checkout.

Where optional package protection is offered, its terms govern eligibility for claims.

Soul TCG may require the customer to cooperate with carrier investigations or claims.

Where a package has been confirmed delivered to the address provided at checkout but is subsequently missing, Soul TCG does not automatically guarantee a refund or replacement, particularly where no applicable shipping protection was purchased.

Nothing in this section limits rights that cannot legally be excluded.

21. International Orders

International customers are responsible for applicable customs duties, taxes, brokerage charges and import fees unless expressly stated otherwise at checkout.

Soul TCG is not responsible for delays caused by customs.

Refusing an international shipment because of duties, taxes or import charges does not automatically entitle the customer to a full refund.

Any shipping, return shipping, brokerage or other amounts incurred by Soul TCG may be deducted where permitted by law.

22. Local Pickup

Orders designated for local pickup must be collected according to the pickup instructions provided by Soul TCG.

Soul TCG may require:

• Order number;
• Government-issued photo identification;
• Identification matching the purchaser; or
• Written authorization for another person to collect the order.

Soul TCG may refuse release of an order where appropriate identification or authorization cannot be established.

Unclaimed orders may be subject to the applicable pickup terms and may ultimately be cancelled, returned to inventory or converted to store credit where permitted.

23. In-Store Purchases

In-store purchases are subject to the Soul TCG Return & Refund Policy.

A customer may request a change-of-mind return before leaving the store with the merchandise.

Once the customer has left the store with the merchandise, change-of-mind returns are final sale unless otherwise stated or required by applicable law.

Defective, incorrectly supplied or otherwise legally protected transactions remain subject to applicable rights.

24. Livestreams, Whatnot & Third-Party Marketplaces

Soul TCG may sell through third-party marketplaces and livestream platforms, including Whatnot.

Transactions completed through those platforms are additionally governed by the applicable platform terms.

Livestream purchases, breaks, Rip & Ship products, randomized games, wheels, mystery products, giveaways and other interactive sales may have specific rules announced before or during the event.

Those event-specific rules form part of the transaction.

Completed randomized results cannot be cancelled merely because a customer dislikes the result, does not receive a desired item, or changes their mind.

25. Events & Tournaments

Where Soul TCG operates events, tournaments or other in-person activities:

• Event tickets may be final sale;
• Event dates, locations and formats may change;
• Participants must follow staff instructions;
• Participants must comply with applicable publisher and organizer rules;
• Cheating, harassment, threats, unsafe behaviour or disruptive conduct may result in removal; and
• Removal for misconduct may occur without refund where permitted.

Additional event rules may apply to specific events.

26. Buylist / Selling Cards to Soul TCG

Where Soul TCG operates a buylist or purchases cards from customers, separate buylist terms may apply.

By submitting cards, you represent that:

• You own the cards or have authority to sell them;
• The cards are not stolen;
• The cards are not counterfeit;
• The cards have not been illegally altered; and
• Your submission information is accurate.

Soul TCG may inspect, grade, reject or reprice submitted cards based on condition, authenticity, completeness or other applicable criteria.

Our assessment of condition is final for the purpose of determining the offer, subject to applicable law.

Soul TCG may refuse counterfeit, altered or otherwise prohibited products and may take appropriate action where fraud or theft is reasonably suspected.

Unauthorized submissions may be rejected or returned.

International sellers are responsible for customs, duties and brokerage charges arising from submissions where applicable.

Danireon specifically includes ownership, condition, counterfeit/custom-card and international customs protections in its terms, while Hobbiesville states that its buylist grading is final and counterfeit/altered/stolen items may be refused.

27. Product Images, Descriptions & Availability

We make reasonable efforts to accurately display products, photographs, colours, specifications, conditions and descriptions.

However:

• Monitor settings can affect colour;
• Manufacturer packaging may change;
• Product images may not depict the exact individual item unless stated;
• Packaging may differ by production run;
• Product specifications may change;
• Inventory may change without notice; and
• Errors may occasionally occur.

Soul TCG does not guarantee that website content is completely current, accurate or error-free at all times.

28. Authenticity

Soul TCG does not knowingly sell counterfeit products.

Products are sourced through legitimate channels to the extent described on applicable product listings or company materials.

If an authenticity concern arises, Soul TCG may investigate the applicable product and transaction.

Nothing in these Terms constitutes a representation that every product is eligible for a manufacturer warranty or third-party grading guarantee.

29. Intellectual Property

All original Soul TCG website content, including our:

• Logos;
• Branding;
• Website design;
• Original photographs;
• Written content;
• Graphics;
• Videos;
• Marketing materials;
• Product descriptions; and
• Other original materials

are owned by Soul TCG or used with permission.

You may not copy, reproduce, scrape, distribute, republish, modify, commercially exploit or create derivative works from our original materials without written permission.

Third-party trademarks, logos, game names, characters, artwork, card images and other intellectual property remain the property of their respective owners.

Use of third-party names or trademarks on our website does not transfer ownership of those rights to Soul TCG.

30. Fan Art & Third-Party Creative Works

Soul TCG may sell, display or promote fan art, artist-created works, custom products and other creative materials.

Where third-party intellectual property appears in such material, rights remain with their respective owners unless otherwise stated.

Soul TCG does not claim ownership of third-party trademarks or copyrighted characters merely because those names or characters appear on a product or listing.

31. User Reviews, Comments & Submissions

If you submit reviews, photographs, comments, suggestions, ideas, contest entries or other content to Soul TCG, you represent that you have the right to submit that content.

You must not submit content that:

• Is fraudulent or misleading;
• Infringes another person's rights;
• Contains malware;
• Is unlawful;
• Is threatening or abusive;
• Contains unauthorized personal information;
• Violates intellectual-property rights; or
• Otherwise violates these Terms.

By submitting content to Soul TCG, you grant Soul TCG a non-exclusive, worldwide, royalty-free licence to reproduce, display, publish, adapt and use that content for operating, marketing and improving our Services.

Soul TCG has no obligation to maintain submitted comments confidential, pay compensation for them, or respond to them.

We may remove content that we determine violates these Terms or is otherwise inappropriate.

32. Prohibited Uses

You may not use the Services to:

1. Violate any law or regulation;
2. Commit or facilitate fraud;
3. Use another person's identity or payment information without authorization;
4. Interfere with the website;
5. Introduce malicious code;
6. Attempt unauthorized access;
7. Scrape or systematically collect website data without permission;
8. Bulk-download listings or pricing;
9. Use bots or automated checkout tools to obtain inventory unfairly;
10. Circumvent purchase limits;
11. Abuse promotional codes;
12. Manipulate contests or giveaways;
13. Impersonate Soul TCG or another person;
14. Infringe intellectual-property rights;
15. Harass, threaten or abuse employees, representatives or customers;
16. Transmit unlawful, obscene, defamatory or malicious material; or
17. Otherwise misuse the Services.

A breach may result in immediate suspension or termination of access.

33. Bots, Scraping & Automated Purchasing

You may not use bots, scripts, crawlers, scrapers, automated checkout systems or similar technology to:

• Circumvent quantity restrictions;
• Automatically purchase limited inventory;
• Manipulate promotions;
• Harvest customer information;
• Bulk-download prices or listings;
• Interfere with website operation; or
• Gain an unfair purchasing advantage.

Soul TCG may use technical and operational measures to detect, restrict or block automated activity.

34. Third-Party Services

The Services may include third-party tools, applications, links, payment processors, shipping providers, analytics services, social-media integrations and other third-party functionality.

Third-party services are provided subject to the relevant provider's own terms.

Soul TCG does not control and is not responsible for third-party websites, content, services, availability, policies or practices.

Any transaction completed directly with a third party is between you and that third party.

35. Privacy

Information submitted through the Services is handled in accordance with the Soul TCG Privacy Policy.

By using the Services, you acknowledge that information may be processed as necessary to operate accounts, process payments, fulfill orders, prevent fraud, communicate with customers, provide shipping services and otherwise operate the business, subject to applicable privacy law.

36. Electronic Communications

When you place an order, create an account, submit a form or contact Soul TCG, you consent to receiving electronic communications relating to your transaction or account.

Electronic communications may include:

• Order confirmations;
• Shipping notifications;
• Pickup notifications;
• Account communications;
• Customer-service communications;
• Policy notices; and
• Other transaction-related messages.

You are responsible for maintaining an email address capable of receiving important communications.

A notice sent to the email address associated with an order or account may be treated as delivered when sent, subject to applicable law.

37. No Guarantee of Website Availability

Soul TCG does not guarantee that the Services will always be uninterrupted, secure, available, accurate or error-free.

The website may be temporarily unavailable due to maintenance, upgrades, technical failures, security events, service-provider failures or other circumstances.

38. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services and website content are provided on an "as is" and "as available" basis.

Soul TCG does not warrant that:

• The Services will meet every expectation;
• The website will be uninterrupted;
• Errors will always be corrected immediately;
• Information will always be complete or current; or
• Third-party services will remain available.

Nothing in these Terms excludes any warranty, condition or statutory right that cannot lawfully be excluded.

39. Limitation of Liability

To the maximum extent permitted by applicable law, Soul TCG, its owners, employees, contractors, affiliates and service providers will not be liable for indirect, incidental, special, punitive or consequential losses arising from use of the Services or products purchased through them.

This includes, to the extent permitted by law:

• Lost profits;
• Lost business opportunities;
• Lost resale value;
• Market-value changes;
• Loss of anticipated savings;
• Loss of data; or
• Similar indirect losses.

To the maximum extent permitted by law, Soul TCG's liability arising from a particular transaction will generally not exceed the amount actually paid to Soul TCG for the affected product or service.

This limitation does not apply where liability cannot legally be excluded or limited.

40. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Soul TCG, its owners, employees, contractors, affiliates and service providers from claims, losses, liabilities, damages, costs and expenses arising from:

• Your breach of these Terms;
• Your misuse of the Services;
• Your violation of applicable law;
• Fraudulent activity;
• Your infringement of another person's rights; or
• Content you submit through the Services.

This section does not require indemnification to the extent prohibited by applicable law.

41. Suspension & Refusal of Service

Soul TCG reserves the right to refuse service, suspend accounts, restrict purchases or terminate access to the Services where reasonably necessary to protect customers, employees, inventory, payment systems, website security or business operations.

Grounds may include:

• Fraud;
• Chargeback abuse;
• Threatening or abusive behaviour;
• Repeated policy violations;
• Promotional abuse;
• Resale-limit circumvention;
• Automated purchasing;
• Suspected stolen payment information;
• Counterfeit activity;
• Harassment;
• Security concerns; or
• Other serious misuse of the Services.

Where required by law, customers retain any applicable legal rights despite such restrictions.

42. Events Beyond Our Reasonable Control

Soul TCG is not responsible for delays or failures caused by circumstances outside our reasonable control.

These may include:

• Severe weather;
• Natural disasters;
• Carrier disruptions;
• Labour disruptions;
• Customs delays;
• Government action;
• Manufacturer shortages;
• Distributor shortages;
• Supply-chain interruptions;
• Recalls;
• System outages;
• Payment-processor outages;
• Cybersecurity incidents; or
• Other force-majeure circumstances.

Where such an event prevents fulfillment, Soul TCG may cancel affected orders or items and provide an applicable refund or other resolution.

43. Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

44. No Waiver

Failure by Soul TCG to enforce any provision of these Terms immediately does not waive our right to enforce that provision later.

45. Assignment

You may not assign or transfer your rights or obligations under these Terms without Soul TCG's prior written consent.

Soul TCG may assign or transfer these Terms, in whole or in part, in connection with a business sale, restructuring, corporate transaction or other lawful transfer.

46. Entire Agreement

These Terms, together with all policies, product-specific conditions, promotion rules and event rules expressly incorporated by reference, form the entire agreement governing your use of the Services and your purchases from Soul TCG.

These may include:

• Return & Refund Policy;
• Privacy Policy;
• Shipping Policy;
• Pre-Order Terms;
• Product-specific terms;
• Promotion rules;
• Giveaway rules;
• Event rules; and
• Third-party marketplace rules applicable to the transaction.

Where a specific product, promotion or event has additional terms, those specific terms apply to that transaction to the extent of any conflict.

47. Changes to These Terms

Soul TCG may update these Terms from time to time.

The current version will be posted on this page with its effective date.

For purchases, the version of the Terms in effect when the order is placed will generally apply to that transaction, subject to any subsequent changes required by law.

Continued use of the Services after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

48. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

Subject to any mandatory consumer-protection or other legal rights that apply, disputes will be subject to the jurisdiction of the courts of Ontario.

49. Consumer Rights

Nothing in these Terms is intended to exclude, waive or restrict any consumer right, warranty, remedy or protection that cannot legally be excluded or restricted.

Where applicable law provides a customer with greater rights than these Terms, those legal rights prevail.
